摘要：在夫妻婚姻关系存续期间内，夫妻为了婚姻关系的存续⽽对财产的归属进⾏约定的婚内 财产约定不同于⼀般赠与协议、离婚财产分割协议和约定财产制。基于婚内财产约定引起的 物权变动属于基于法律⾏为的物权变动，不需要经过物权变动公示即能够在夫妻内部产⽣生物 权变动的效⼒，原则上不具有对外效⼒。但对此问题，由于⽴法不明，理理论界没有统⼀的论 调，因此会产⽣生同案不同判的现象。本⽂着眼于婚姻关系这⼀特殊契约背景，运⽤案例例和⽐较分析的⽅法对域外制度进⾏评析借鉴，从⽽提出相关的完善建议。

Abstract：During the marriage, couples enter a contract to determine the ownership of the property which is different from a contract of gift, an agreement  concerning  the pision of property in the porce and statutory regime as to marital property. The validity falls into two parts: inter and external validity and effectiveness. Marital property agreement belongs to scope of the change of property right caused by juristic acts. Without publicity, the agreement is effective to the couples but does not produce legal binding to others in the transaction. As a result of some shortcomings of the current laws and unified theories, the application of law in the judicial practice is not unified. To solve the problems mentioned above, the author  focuses on the cases and uses the method of comparative analysis to compare the marital  property agreement with other countries, and puts forward some relevant  solutions.
