上海市农民工工伤保险权益缺失研究

Study of migrant workers lacking inductrial injury insurance rights and interests in Shanghai - Jiading district as an example
Abstract: with the promotion of modern science and technology, rural productivity level unceasing enhancement, the rural surplus labor liberation pouring into cities, start in non-agricultural production. Although in order to protect the legitimate rights and interests of enterprise employees, China has formulated and implemented a series of laws and regulations, such as "labor law", "labor contract law" and "social insurance law", etc., in 2010 to "byelaw of inductrial injury insurance" the major revision, but for rural migrant farmers' cultural level and professional technology, the enforcement of administrative authority and business owners and worker legal consciousness and other factors, security violation cases emerge in endlessly, including administrative confirmed cases to compare the typical inductrial injury. In order to improve the social from all walks of life to the main force for the construction of urbanization, rural migrant farmer inductrial injury insurance, the author analyses the main reasons for such cases, puts forward corresponding countermeasures, in order to help migrant workers inductrial injury protection.
