摘    要 同一犯罪构成内的打击错误历来都是事实认识错误理论当中争议最为激烈的类型。针对具体的打击错误问题的处理，应当首先建立在确定打击错误的范围之内进行讨论，就具体的打击错误而言应当尤其注意其与具体的对象错误的区分。其次，具体符合说和法定符合说是当下的两大主流学说，针对打击错误问题所提出的不同处理原则归根结底其争议在于：对“故意”做具体还是做抽象化的理解。具体符合说在处理打击错误问题上并没有给出实际的操作方案，具体到何种程度才承认其符合性，则是没有解决的问题。而法定符合说平等地保护了法益，数故意说并不意味着成立数个故意杀人罪，而是按照想象竞合犯以一个故意杀人罪处理也并不违反责任主义的原则。因此，在处理具体的打击错误问题上应当坚持法定符合说。90382
